DIVISION IN KIND

Whether real property in Virginia may be sold as a single parcel or divided โ€œin kindโ€ is typically determined by the circuit courts by authority of Virginia Code ยง 8.01-83, pursuant to a Complaint filed by one or more co-owners (who may be unable to agree on disposition of the property).
