Why does it now make even more sense for your small business (less than 3 employees) to carry Workers’ Compensation Insurance? Effective July 1, 2014, the maximum penalty for the failure of a business to obtain workers’ compensation insurance will be $50,000.00, up from the current maximum of $5,000.00.
In addition to avoiding the statutory penalties, business owners will obtain the following advantages by obtaining workers’ compensation coverage:
- The coverage will provide a cost of defense, as well as indemnity for claims that are filed; and
- The owners can elect to obtain coverage for themselves. The additional coverage can usually be added for a reasonable cost, and includes disability benefits as well as lifetime medical expenses for the covered injury.
The claims against uninsured businesses are paid by the Uninsured Employers Fund. That Fund has subrogation rights and retains the right to bring a civil action against the uninsured business for full recovery of all amounts paid to the injured worker.
