We represent clients through the Washington, DC metropolitan area. However, the majority of our time is spent on cases filed in the federal and state courts that have jurisdiction cover Fairfax, Prince William, Loudoun, Arlington, Fauquier, and Frederick Counties in Virginia as well as the Cities of Alexandria and Winchester.
HOW DO I KNOW WHAT MY CASE IS WORTH?
Evaluation is one of the keys to obtaining favorable results, and understanding what your damages are and who the defendant(s) may be are critical to evaluating how much you might be able to recover. There is no mathematical formula, but a number of factors must be considered:
- Liability (who is at fault and why)
- What injuries have been sustained?
- Are those injuries permanent?
- What medical expenses have been incurred?
- Has there been a loss of future earning capacity, and if so, in what amount?
- What is the available insurance coverage? If the amount of insurance coverage is inadequate, does the defendant have resources to pay an excess judgment?
- Is under-insured or uninsured motorist coverage available?
- Who is the insurer?
- Who is likely to defend the claim?
We also discuss with you the costs of litigation. While McCandlish can structure a compensation plan to fit your needs, understanding and preparing to deal with the emotional strains and time demands of litigation is important too. After relevant information is obtained, one of our trained professionals will be able to provide our case evaluation and recommendation.
ARE THERE TIME LIMITS FOR FILING A PERSONAL INJURY ACTION?
Yes. It is very important that you know the legal deadlines for filing your case so that it will not be barred by the statute of limitations.
WHAT WILL I NEED TO PAY?
Personal injury cases are normally handled on a contingent fee basis. The fee is based on the recovery, and there is no fee if there is no recovery. There are certain costs (e.g. filing fees, expert witness expenses, and subpoena charges) that the client must pay. Our law firm often advances these expenses.
